Terms and Conditions — Vendors

Please read carefully.

1. Vendors must be of the age of majority to register and participate in the event.
2. Vendors will not exceed the space allotted by the Organizers.
3. Vendors must be present throughout the day. Vendors are not permitted to pack up and leave before the market closes.
4. Vendors are responsible for weatherproofing their booths and setups.
5. Vendors must have sufficient inventory for the duration of the event.
6. The Vendor agrees to promote the event by making no less than one (1) feed post and one (1) story on social media.
7. Vendors must read all email updates with regard to the market.
8. Vendors must comply with all applicable laws, bylaws and regulations including, without limitation, City of Winnipeg Fire Department, Health Department, and Water and Waste requirements. All food vendors must have a Food Handler Certificate and a Health Permit.
9. Vendors must clean up after themselves and must not leave any garbage at the end of the day.
10. Non-Exclusivity: The Organizers reserve the right to contract with other vendors for the event who sell similar and/or the same products.
11. Set-Up and Tear-Down: Vendors must abide by the set-up and tear-down schedule. The Vendor must clean up after themselves and will be responsible for removing all materials and equipment.
12. Limitation of Liability: The Organizers shall not be liable to the Vendor for any special, incidental, punitive, exemplary, indirect or consequential damages or losses whatsoever including, without limitation, damages for loss of business, loss of profits, business interruption, loss of business information, loss of goodwill, sickness (including but not limited to COVID-19), and work stoppage arising out of this Agreement.
13. Cancellation:
    • By the Vendor. In the event the Vendor has to cancel, they must notify the Organizers in writing (via email) no later than seven (7) days before the market.
    • By the Organizers. If the event is cancelled due to inclement weather, the Organizers will credit the Vendor a spot for a future market.

This agreement commences on the date of application and continues up until the end of the market.
