Terms and Conditions — Organizers
For event organizers — please read carefully.
These Terms and Conditions govern your use of Fairhub as an Organizer of a fair, market, or event. By creating or publishing an event, the Organizer agrees to the following. In these Terms, "Fairhub" means this website and its operators.
1. Accurate Event Information
The Organizer must provide accurate, complete, and current information about the event — including its name, location, dates, hours, and description — and update it promptly whenever anything changes.
2. Vendor Space and Facilities
The Organizer will provide each Vendor with the space and any facilities or amenities agreed at the time of booking, and will not allocate the same space to more than one Vendor.
3. Safe and Accessible Site
The Organizer is responsible for ensuring the event site is safe and reasonably accessible for Vendors, staff, and visitors, and for obtaining all permits, licences, and insurance required to hold the event.
4. Compliance with Laws
The Organizer must comply with all applicable laws, bylaws, and regulations, including, without limitation, fire, health, food-safety, and accessibility requirements applicable to the event and its location.
5. Promotion of the Event
The Organizer agrees to promote the event through reasonable means so that participating Vendors receive fair exposure to attendees.
6. Communication
The Organizer will respond to Vendor enquiries in a timely manner and will give Vendors reasonable advance notice of any change to the schedule, layout, or policies that affects their participation.
7. Set-Up and Tear-Down
The Organizer will provide a clear set-up and tear-down schedule and ensure Vendors have safe access to the site during the designated times.
8. Vendor Fees and Payments
The Organizer is responsible for setting Vendor fees accurately on Fairhub, for honouring the price shown to a Vendor at the time of booking, and for issuing any refunds owed to Vendors in accordance with these Terms.
9. Vendor Selection
The Organizer may select or decline Vendors at its discretion but must not discriminate on any ground prohibited by applicable law, and must apply its stated participation rules consistently.
10. Fairhub Fees and Accurate Listings
The Organizer agrees to pay all Fairhub fees and commissions when due and to keep its listings truthful. The Organizer must not post false, misleading, infringing, or unlawful content on Fairhub.
11. Account Responsibility
The Organizer must be of the age of majority and is responsible for all activity under its account. Fairhub uses two-factor authentication — a one-time code sent to the Organizer's email — instead of passwords, so the Organizer must keep access to that email account secure.
12. Buyers and Visitors
Where admission or tickets are sold through Fairhub, the Organizer is responsible for providing accurate ticket and entry information and for honouring its stated refund, entry, and conduct policies toward buyers and visitors.
13. Non-Exclusivity
Fairhub reserves the right to host other events and to work with other organizers, vendors, and visitors, including those offering or attending similar and/or competing events.
14. Indemnification
The Organizer agrees to indemnify and hold harmless Fairhub and its operators against any claim, damage, or loss arising out of the event or the Organizer's breach of these Terms.
15. Limitation of Liability
Fairhub shall not be liable to the Organizer for any special, incidental, punitive, exemplary, indirect or consequential damages or losses whatsoever including, without limitation, damages for loss of business, loss of profits, business interruption, loss of business information, loss of goodwill, sickness (including but not limited to COVID-19), and work stoppage arising out of this Agreement.
16. Cancellation
- By the Organizer. If the Organizer has to cancel the event, they must notify Fairhub and all registered Vendors in writing (via email) no later than seven (7) days before the event, and must refund Vendor fees in accordance with the stated cancellation policy.
- By Fairhub. Fairhub may suspend, remove, or cancel an event that breaches these Terms or any applicable law, or where necessary to protect Vendors, buyers, or visitors.
This agreement commences on the date the event is created on Fairhub and continues until the event has concluded and all related obligations, including any refunds, have been settled.
